Duties Description Under the direction and guidance of senior level Labor Relations staff, the candidate for this position will:

Advise managers and staff in the application of all applicable: CBA provisions; agency and state policies and procedures; and any labor relation applicable laws or rules that govern or impact agency staff.

Become proficient in labor relations procedures including but not limited to: administering the discipline process; answering and evaluating grievances; developing and providing counseling guidance; implementing the workplace violence prevention program; administering the OTETA process; evaluating and implementing EHS procedures, and adhering to and implementing ADID processes.

Provide support and make recommendations to managers regarding counseling and progressive discipline.

Administer and implement all aspects of the grievance process including conducting Agency level/Step 2 meetings with grievants, union representatives, and program management.

First and second chair in representing the agency at grievance meetings and hearings, full and expedited disciplinary arbitration hearings, and unemployment insurance hearings.

Development and collaborate on the development of clear, accurate and comprehensive written work product including: grievance decisions; draft investigative summaries; arbitration opening statements; arbitration closing arguments; agency policy; Notices of Discipline; Notices of Suspension; Stipulations of Settlement; and all communications set forth by Labor Relations.

Conduct in person and remote/virtual: training presentations; witness preparations; staff interviews; witness interviews; disciplinary interrogations; and negotiations when applicable.

Participate in statewide Labor/Management Committee meetings.

Develop professional and productive working relationships with agency staff and their respective representatives, and all levels of agency management.

Confer with the Governor's Office of Employee Relations and other control agencies as needed.

Provide direct and indirect supervision of a Labor Relations staff when applicable.

Day and overnight travel when necessary and sometimes with very short notice (10%).

Communicate effectively with all program areas within NYSDEC regarding LR actions.

Effectively work with while adequately providing notice and guidance to appropriate staff to properly effectuate Labor Relations work.

Perform Labor Relations work on behalf of and in the best interest of NYSDEC as a whole.

Complete other duties and special projects as assigned.

Must have a strong work ethic. Must possess professional and effective oral and written communication skills and must be willing and able to follow all work rules, policies and procedures.

Must be able to work independently at the office, while traveling to NYSDEC locations; and while working remotely, if applicable.

- Currently in the title of Human Resources Specialist 2 (Labor Relations) and an employee of DEC or

Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.
